Catalina provides mobile, online and in-store personalized digital media solutions, including in-store and digital coupons and shopper-based communications, on behalf of manufacturer, marketing and retail clients. At Catalina, we take consumer privacy seriously. For more than 30 years, we’ve been committed to employing the highest standards of protection for the data we collect or maintain across the globe. We continuously strive to strengthen our protection measures to maintain the consumer trust that is paramount to our continued success and to that of our business partners.

Our Privacy Principles/Standards guide the way we conduct business each day, including our business relationships with many of the world’s leading CPG retailers and brands to provide mobile, online and in-store personalized digital media.

Our Commitment to Transparency and Consumer Choice

In today’s rapidly evolving digital marketplace, we recognize the importance of transparency and allowing consumers to direct how and when they communicate with companies, and how companies share data about them with others. Here’s what you need to know as a consumer:

One of Catalina’s core services is providing data analysis for retailers and other clients relating to shopper purchasing behavior, including loyalty card programs. The shopper data Catalina receives from retailer clients related to those programs is typically provided using a loyalty or other program identifier number, not your name. Catalina also assigns another unique identifier to this data. Catalina does not use either the information received from the retailer, or generated from Catalina processing services, to recreate and retain specific personal information about shoppers, such as name, address and email address. Catalina does not sell personal information we collect on our Sites. You can opt out of the digital services in which we are involved by visiting the Digital Advertising Alliance website. If you have questions about the use of your data by a retailer in connection with their loyalty card or other shopper reward programs, please review the privacy policies and practices, and program terms of use, of that retailer. Catalina takes reasonable precautions to keep our sites and systems secure and to prevent personal data from being made available to any unauthorized person or business, no information transmitted online or stored electronically is 100 percent secure. We encourage you to use caution when disclosing your information online. By protecting your username and password from third-party access, and selecting passwords that are secure, you can help ensure the security of your data.

Our Policy

This Privacy Policy applies to information collected by Catalina Marketing® Corporation (“Catalina®”) in its U.S. operations through the website(s), applications or online services on which this policy is posted, including www.catalina.com (the “Sites”). It does not apply to information we collect or maintain in connection with our other websites or services. This Policy also describes how Catalina® uses and discloses the information we collect, on behalf of our retail partners located in the United States related to their loyalty and rewards programs.

ABOUT US

Catalina® provides mobile, online and in-store personalized digital media solutions, including in-store and digital coupons and shopper-based communications, on behalf of manufacturer, marketing and retail clients.

INFORMATION COLLECTION

We may collect information directly from users of our Sites, as well as indirectly, through the use of cookies and other technologies. In addition, we also collect or receive additional information from our clients in order to provide our services, including rewards programs services.

Information We Collect Directly. We may collect personal information through our Sites and mobile apps, including name, email address, phone number, job history, demographic information, and other information that you provide to us.

Information We Collect For Rewards Programs. We provide in-store applications and related support to our retail clients to help them administer their loyalty and rewards programs. As part of these services, we collect certain rewards program participant data coded with a loyalty number or other customer identifier provided by the retailer. This data is then associated with a unique, Catalina®-assigned identifier which is used to aggregate purchasing activity data for that identifier (“Rewards Program Data”). Catalina® does not use the Rewards Program Data or that data we receive from retailers to recreate and retain specific personal information, such as names, addresses, emails of loyalty program participants. Our retail clients may associate Rewards Program Data from their loyalty programs with other information, including personal information, but their use and disclosure of that data, as well as any related opt-out features that may be available to consumers through the retailer, are beyond Catalina’s control and is subject to the retailers’ own privacy policies and practices.

Data Collected from Third Parties and Affiliates. We may collect certain information from third parties and affiliates, which we use to enhance the data we have collected. For example, we may engage a third-party provider to append demographic data and other non-personally identifying information to the data we collect.

Information We Collect Automatically. We may also passively collect information from you when you visit our Sites, or use our mobile applications or services. We use a variety of tools, such as cookies, log files, Java™, pixel tags and local stored objects to collect information about your use of our Sites. For example, we may collect your domain name; your browser type and operating system; web pages you view; links you click; your IP address; the length of time you visit our Site and or use our services; and the referring URL, or the webpage that led you to one of our Sites. We also operate certain mobile applications on behalf of our retail clients that collect: geolocation information; mobile device ID (or alternative ID where required by your platform provider); language information; name and model; operating system, type, and version; your activities within the app; and the length of time that you are logged into our app. We may combine this information with the other information we have collected from you.

HOW WE USE INFORMATION

Generally, we use personal information we collect directly from you for the purposes described at the time of collection, to process your requests, to provide you with the services and information you request, and to communicate with you about your requests. We may also use your information as follows:

  • To provide you with marketing and other information that we think may interest you (unless you have opted out).
  • To tailor the advertising, content and information that we may send or display to you, on our Site, to offer location customization, personalized help and instructions and to otherwise personalize your experiences while using the Sites.
  • To display targeted advertising on third-party sites, mobile applications and other media, on behalf of Catalina® and on behalf of our clients.
  • To provide our services to retailers and other clients, including sending or displaying offers, in-store and online, to consumers on behalf of our clients.
  • To improve our Sites and services.

We use de-identified or non-personal information (including passively collected information) for market research and analysis to better understand how users access and use our Sites, to respond to user desires and preferences, and for other business, research and analytical purposes, including marketing and advertising. When we do, so, we do not use name, contact information or similar personal identifiers to identify specific individual consumers.

HOW WE DISCLOSE INFORMATION

As noted above, we do not sell or rent your personal information collected via our Sites. However, we may disclose your information, where we have your consent, or as set forth below:

  • Service Providers. We may disclose the information we collect from you to third-party vendors, service providers, contractors or agents who perform functions on our behalf.
  • Business Transfers. If we are acquired by, or merged with, another company, if part or substantially all of our assets are transferred to another company, or as part of a bankruptcy proceeding, we may transfer the information we have collected from you to the other company.
  • In Response to Legal Process. We may disclose the information we collect from you in order to comply with the law, a judicial proceeding, court order, subpoena, or other legal process.
  • To Protect Us and Others. We may disclose the information we collect from you where we believe it is necessary to investigate, prevent or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety of any person, violations of our Terms of Use or this Policy, or as evidence in litigation in which we are involved.
  • Aggregate and De-Identified Information. We may share aggregate and de-identified information with third parties for marketing, advertising, or research purposes.

We also disclose Rewards Program Data to the retailer on whose behalf such data was collected, as well as other third parties as directed by such retailers. As noted above, retailer use and disclosure is subject to their own privacy policies and practices.

We retain personal information and other information for as long as necessary for its legitimate business purposes, and as otherwise permitted by applicable law.

OUR USE OF COOKIES AND OTHER TRACKING MECHANISMS

We use cookies, LSOs, clear GIFs and other tracking mechanisms to track information about your use of our Sites and Apps, as described above. We may combine this information with other personal information we collect from you.

Cookies. Cookies are alphanumeric identifiers that we transfer to your computer’s hard drive through your web browser for record-keeping purposes. Some cookies enable a faster log-in process, and some allow us to track your activities at our Sites. Most web browsers automatically accept cookies, but if you prefer, you can edit your browser options to block them in the future. The “Help” portion of the toolbar on most browsers will tell you how to disable cookies or change your cookies settings.

Clear GIFs, pixel tags and other technologies. Clear GIFs are tiny graphics with a unique identifier, similar in function to cookies, which are embedded invisibly on web pages. We may use clear GIFs (a.k.a. web beacons, web bugs or pixel tags), in connection with our Sites to track the activities of visitors to our Sites, help us manage content, and compile statistics about usage of our Sites. We may also use clear GIFs in HTML emails to our clients, to help us track email response rates, identify when our emails are viewed, and track whether our emails are forwarded.

Local Storage Objects. We may use Local Storage Objects (“LSOs”), including Flash LSOs, to store your preferences and to personalize your visit. LSOs are different from browser cookies because of the amount and type of data stored. Typically, you cannot control, delete, or disable the acceptance of LSOs through your web browser. For more information on Flash LSOs, or to learn how to manage your settings for Flash LSOs, go to the Adobe® Flash Player Help Page, choose “Global Storage Settings Panel” and follow the instructions.

Embedded Scripts. An embedded script is programming code that is designed to collect information about your interactions with our services, such as the links you click on. The code is temporarily downloaded onto your device from our web server or a third- party service provider, is active only while you are connected to the services, and is deactivated or deleted thereafter.

Third-Party Analytics. We also use automated devices and applications, such as Google® Analytics, to evaluate usage of our Sites and the services we provide. We use these tools to gather non-personal information about users to help us improve our services, performance and user experiences. These analytics providers may use cookies and other technologies to perform their services, and may combine the information that they collect about you on our Sites with other information that they have collected. This Policy does not cover such third parties’ use of the data.

NETWORK ADVERTISING

As part of the Catalina BuyerVision® service, Catalina® works with third parties, such as network advertisers, to display advertisements on behalf of Catalina® clients on third party sites, including 4Info®, AOL® Advertising and BrightRoll®. Catalina® adheres to the Digital Advertising Alliance (“DAA”) Self-Regulatory Principles for Online Behavioral Advertising. Catalina® and these third parties display advertisements based on your use of our Site and other third-party websites, as well as based on other data. We may use additional demographic, purchase and other non-identifying data that we collect to help us place targeted ads on particular websites. This enables us and these third parties to direct advertisements by displaying ads for products and services in which you might be interested. Network advertisers may use cookies, JavaScript®, web beacons, Flash LSOs, and other technologies to measure the effectiveness of ads and to personalize advertising content to you; the information they collect and use is subject to their own privacy policies, not this one. They may also use your location or geolocation information to serve ads to you.

We may provide these third-party advertisers with information about your usage of our Sites, as well as other aggregate or demographic information; however, we do not share personally identifiable information with these third parties, and we do not permit these third parties to use cookies and other tracking technologies to collect such information about you on our Sites.

You can opt out of receiving behaviorally targeted ads through the Catalina BuyerVision® Network via the Digital Advertising Alliance’s universal opt out tool. You can also opt out of receiving behaviorally targeted ads from many other third-party advertisers who are also DAA members, using this tool. For more information regarding this practice by Catalina® and other DAA members, and your choices regarding having this information used by these companies, including how to opt-out of third-party ad networks operated by DAA members, please visit www.aboutads.info/choices.

Opting out of one or more DAA member networks (many of which will be the same) only means that those members no longer will deliver personalized content or ads to you. It does not mean you will no longer receive any personalized content. You may also continue to receive advertisements, for example, based on the particular website that you are viewing. Also, if your browser is configured to reject cookies when you visit this opt-out page, or you subsequently erase your cookies, use a different computer or change web browsers, your DAA opt-out will no longer be effective.

Do-Not-Track options. Currently, our Sites do not honor browser requests not to be tracked. You may, however, opt out of many third-party ad networks, including those operated by members of the DAA, as noted above.

COUPONS

We may operate, on behalf of our retail clients, an online coupon service, which uses a plug-in to make coupons available to our client’s customers. Through this plug-in, we may automatically collect information as described under the “Information We Collect Automatically” section above. We may share the information with the retailer clients on whose behalf we are operating coupon services, and may use this information to personalize the coupon offers we display.

SECURITY

We have implemented safeguards to help protect the privacy of data and personal information you transmit through use of our Sites. However, no information transmitted online or stored electronically is 100% secure. We encourage you to use caution when disclosing information online. Often, you are in the best situation to protect yourself online. You are responsible for protecting your username and password from third-party access, and for selecting passwords that are secure.

From time to time, we will provide links to third-party websites, or our advertisements will contain links to third-party sites. For example, we may link to a third party who is assisting in or is providing online training services. These links are provided as a service to you. These sites are operated by independent entities with their own privacy policies. This Privacy Policy does not apply to such other sites or to the use that those entities make of your information. Catalina® has no control over the content displayed on such sites, nor over the measures, if any, that are taken by such sites to protect the privacy of your information.

HOW TO MODIFY YOUR INFORMATION OR PREFERENCES

Catalina® has provided in this Policy information on how you can change your preferences, including opt-outs, with respect to marketing or advertising done by retailers in connection with their loyalty programs or otherwise, and also by Catalina®’s own BuyerVision® Network. If any questions remain about these processes, you can e-mail us at privacy@catalinamarketing.com. If you have registered for an account with us, you may update your personal information by logging into your account.

CHILDREN

Our Sites are intended for a general audience and are not intended for use by children under the age of 13. We do not knowingly collect personal information from any visitor under the age of 13. If you are a parent of a child under 13, and you believe that your child has provided us with information about him or herself, please contact us at privacy@catalinamarketing.com.

TRANSFER OF YOUR INFORMATION TO THE UNITED STATES

The Sites and mobile applications are operated from the United States. If you are located anywhere outside of the United States, please be aware that information we collect, including, personal information, may be transferred to, processed and stored in the United States. Where the data transfer route is no longer available, an appropriate alternative will be put in place.

Data may also be accessed by vendors from other locations in compliance with the US Safe Harbor requirements of the EU data protection laws. The data protection laws in the United States may differ from those of the country in which you are located, and your personal information may be subject to access requests from governments, courts, or law enforcement in the United States according to its laws. By using our services or providing us with any information, you consent to this transfer, processing and storage of your information in the United States.

EU & SWISS SAFE HARBOR

Catalina® is a participant in the U.S.-EU & U.S.-Swiss Safe Harbor programs administered by the U.S. Department of Commerce, and agreed to by the European Union and the Federal Data Protection and Information Commissioner of Switzerland. We have self-certified that we adhere to the Safe Harbor Privacy Principles with regard to our use of the personal information we collect from residents of the European Economic Area and Switzerland. YOUR CALIFORNIA PRIVACY RIGHTS

We do not share your personal information with third parties for the third party’s own direct marketing purposes without your consent. California residents may request a disclosure of certain information relating to our sharing of their personal information by contacting us at privacy@catalinamarketing.com and requesting your “California Privacy Notice.” Please allow up to 30 days for us to respond.
